Fees and Expenses



Arbitration

Fixed rate for a scheduled day or part thereof: $2,500. Standard time charge for all other services in respect of a hearing, including preparing a written decision: $325 per hour.

For travel time to Cape Breton, New Brunswick, Prince Edward Island and Newfoundland, add $600 to total.

Fee Estimate for 1 full day arbitration, including pre-arbitration matters; attending hearing; and preparing written decision: $4,500 to $5,000.

Delivery of written decisions is projected within three weeks of date of last hearing or written submission.

Additional Costs:

  • mileage $.45 per kilometer
  • where the arbitration requires travel more than two hours from Halifax, then add the cost of accommodation (or airfare, depending on the distance), meals, etc.
  • airfare (standard economy) where necessary: at cost
  • rental cost of hearing rooms: at cost

NB: arbitrations under the Condominium Act, Trade Union Act or other legislation may be subject to different rates prescribed by regulation or the appropriate authority. In such cases those rates apply in place of the above.

Liability for fees: As per paragraph 17 of the Sample Arbitration Agreement.

Mediation

Fee for 1 day mediation is in the range of $2,500-$3,500, depending on the size of the briefs, the time taken and any other factors adding to the complexity of the matter. Fee for mediations involving more than two parties will be in the $3,500-$4,500 (and up) range, depending on the same factors.

For travel time to Cape Breton, New Brunswick, Prince Edward Island and Newfoundland, add $600.

Liability for fees: As per paragraph 8 of the Sample Mediation Agreement.

Cancellation Fees for Arbitrations/Mediations

If cancelled more than 35 days prior to the scheduled date, there is no charge.

If cancelled between 35 days and 28 days before the scheduled date: $1,000 per scheduled day.

If cancelled between 27 days and 14 days before the scheduled date: $1,250 per scheduled day.

If cancelled between 13 days and 2 days before the scheduled date: $1,500 per scheduled day.

If cancelled less than 2 working days before the scheduled date, or on the scheduled date: $2,200 per scheduled day.

* Accounts are net 30 days and thereafter interest at 6% per annum is charged.

* All parties are jointly and severally liable for all cancellation fees (including those for room rentals).
